HRERA Orders ₹30,000 Rent for Green View Society Allottees

In a significant decision, the Haryana Real Estate Regulatory Authority (HRERA) has directed the National Buildings Construction Corporation (NBCC) to compensate allottees of the Green View Society in Sector 37D, Gurugram. The regulatory body ordered NBCC to pay ₹30,000 per month in rent to affected allottees after the project was deemed structurally unsafe.
The issue surfaced when two allottees, Saurabh Mehta and Jai Prakash Mehta, filed a complaint with HRERA following independent structural audits conducted by IIT-Roorkee and the Central Building Research Institute (CBRI). Both audits declared the Green View Society unfit for habitation, leading to residents being ordered to vacate their flats by March 2022.
HRERA’s Ruling
According to HRERA’s recent order, NBCC must provide compensation within a month. Failure to do so will result in an interest rate of 10.5% per annum being applied until the full amount is paid. Despite several attempts, NBCC officials declined to comment on the matter.
Demolition Delays and Compensation Disputes
Earlier this year, the Gurugram district administration denied NBCC permission to demolish the seven towers of Green View Society due to ongoing legal disputes and pending compensation claims, particularly from the Economically Weaker Section (EWS) allottees.
EWS flat owners had raised objections in the Delhi High Court, alleging that NBCC failed to settle their compensation claims. During a “Samadhan” grievance camp organized by the district administration, EWS residents reiterated their demands for clarity on compensation and urged authorities to ensure fair treatment.
The District Town Planning Enforcement (DTPE) team informed NBCC that demolition could not proceed without explicit permission from the Delhi High Court. DTPE also requested the deputy commissioner to issue clear guidelines to help EWS allottees register their flats and safeguard their claims against NBCC.
NBCC Defends Demolition Request
NBCC has emphasized the urgent need to demolish the unsafe towers, citing the risks to life and property. The developer referenced a 2022 order issued by the district magistrate and the District Disaster Management Authority (DDMA), which also highlighted structural dangers.
As the legal battle continues, the allottees of Green View Society await resolution, hoping for clarity on compensation and the fate of their homes.
