UP-RERA Fines Ansal Properties ₹14.41 Cr for Violations

The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has penalized Ansal Properties and Infrastructure ₹14.41 crore for violating Section 3 of the RERA Act. The infractions involve executing 329 sale agreements in unregistered pockets of the Sushant Golf City project in Lucknow over the span of March 2022 to August 2024.

Violation Details Across Sectors

The unauthorized transactions were spread across several sections of Sushant Golf City, with the following breakdown:

  • Sector M: A total of 58 sales were carried out in Pockets 1A and 2.
  • Sector H: 136 sales across Pockets 1, 2A, 2B, 2C, and another unregistered area.
  • Sector J: 48 sales in Pocket 1.
  • Sector G: 82 sales in Pockets 3B and 5.
  • Sector F: 4 sales in Pocket 2A.
  • Sector B: 1 sale in Pocket 4.

Failure to Respond to Notices

UP-RERA had repeatedly issued notices to the Ansal Properties, requiring an explanation for its actions. However, the promoter did not respond to the initial notices or comply with extended deadlines. After a hearing during UP-RERA’s 161st meeting, the company was granted an additional 15 days to respond. Despite this, a consolidated reply was submitted instead of addressing each notice separately.

Following a detailed review of the written response and the records, UP-RERA determined that the explanation lacked legal merit. As a result, the penalty was imposed under Section 59(1) of the RERA Act, amounting to 10% of the estimated value of sales from unregistered areas.

Compliance Deadline

The Ansal Properties has been directed to pay the ₹14.41 crore fine within 30 days. If the penalty is not paid, additional measures will be initiated under Section 59(2) of the RERA Act.
