UP-RERA Directive Ensures Accurate Completion and Occupancy Certificates

The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has issued a directive to competent authorities, emphasizing the need to adhere strictly to legal standards when issuing completion certificates (C.C.) and occupancy certificates (O.C.). This UP-RERA Directive aims to eliminate discrepancies and enhance transparency in the real estate sector.
UP-RERA has mandated that authorities must refrain from issuing temporary C.C.s or O.C.s that are not permissible under the prevailing laws. This measure is essential to uphold the integrity and legality of the certification process. Authorities are now required to provide specific details of the relevant towers or blocks for which part-C.C. or O.C. is being issued. Additionally, they must include the names of all towers, blocks, or phases of the project to ensure clarity and consistency.
It has been observed that the names of completed towers, blocks, or units mentioned in part-C.C.s or O.C.s often do not match the names provided by the promoter during project registration with RERA or in the agreement for sale (BBA). This inconsistency has been causing confusion among home buyers regarding the completion status of their units. Sanjay Bhoosreddy, Chairman of UP-RERA, highlighted that the mismatch in names creates doubts in the minds of home buyers about the status of their units at the time of finalizing the conveyance deed and transferring possession. This issue can be easily resolved with due diligence at the level of planning authorities.
To prevent such discrepancies, the UP-RERA has advised planning authorities to obtain the marketing name of the project, its towers/blocks, and the number of units from the promoter. These exact names should be used when issuing completion or occupancy certificates. By following these recommendations, planning authorities can avoid any doubts regarding the completion status of the project or its various components.
The UP-RERA Directive is a crucial step towards ensuring transparency and trust in the real estate sector.
