Stilt-Plus-Four Buildings: Haryana’s Ban on Fourth Floors

If you are considering purchasing a fourth floor in a ‘stilt-plus-four’ building on a residential plot, it is crucial to ensure that the floor was not constructed after February 23, 2023. The Haryana government imposed a ban on constructing such floors from this date. The district town planner (DTP) of Gurgaon has clearly stated that any fourth floors built after this date will not be registered for sale or purchase and may face demolition.

The DTP emphasized, “Homeowners must restore all unauthorized constructions to their original state and avoid any sale or purchase of fourth-floor units. Any violation of this government order will lead to the immediate revocation or cancellation of the occupation certificate (OC) and disciplinary action against the owner, architect, and all stakeholders involved.”

In a communication released on May 19, the DTP also notified the public and all practicing architects that no OC should be issued for buildings with unapproved fourth floors. All occupation certificates must comply with the established guidelines.

Fourth Floors Built After February 2023 to be Demolished

The guidelines issued on February 23, 2023, by the Department of Town and Country Planning Haryana, and other applicable norms of the Haryana Building Code-2017, explicitly prohibit the construction of ‘stilt-plus-four’ floors on residential plots. Despite this ban, some architects have issued OCs for buildings where the fourth-floor plans were not sanctioned before the ban.

A further clarification on May 3 from the director of the Town and Country Planning Department Haryana stated that legal action would be taken against any unauthorized OCs issued for fourth floors without prior approval. Immediate action is required to restore such constructions to their original state.

Sources within the department confirmed that the DTP Gurgaon’s clarification applies to all buildings constructed across the state after February 2023.
