NGT Noida Construction Ban on Projects Without Clearances

The NGT Noida Construction Ban has been implemented to prevent construction activities in Noida and Greater Noida for projects lacking the necessary environmental clearances. This decision follows allegations of unauthorized construction of residential and commercial buildings, illegal topsoil extraction, and unapproved borewell operations in the region.

In an order dated December 9, the NGT bench, led by Chairperson Justice Prakash Shrivastava, underscored the importance of environmental compliance. The bench, which also included Justice Sudhir Agarwal and expert member A Senthil Vel, stated:

“Authorities have submitted their responses, which show that some project developers are proceeding with construction without securing Consent to Establish (CTE), Consent to Operate (CTO), and Environmental Clearance (EC).”

As part of the NGT Noida Construction Ban, the Tribunal directed the Uttar Pradesh Pollution Control Board (UPPCB) and state authorities to stop any ongoing construction projects that do not comply with environmental norms. These activities will remain halted until the required clearances are obtained.

Large-Scale Violations Under Scrutiny

The petition, submitted by BJP leader and former Municipal Corporator Rajendra Tyagi, highlights illegal construction activities in 56 villages of Greater Noida and 18 villages of Noida. The petition claims that over 20,000 hectares of fertile agricultural land in Greater Noida have been converted into unauthorized colonies, while a similar area in Noida is being used for illegal land plotting.

During the hearing, the petitioner’s counsel, Akash Vashishtha, presented photographs and evidence showing ongoing violations. He emphasized how huge construction projects continue to rise daily in violation of environmental norms.

“We have provided substantial evidence to show the daily rise of large construction projects,” Vashishtha stated.

Environmental Protection Measures

The NGT Noida Construction Ban also addresses the issue of land plotting in floodplain zones. The Tribunal has ordered the UPPCB to take immediate action to prevent such illegal activities, further reinforcing the need for sustainable urban development and environmental protection in the region.

This decision highlights the increasing scrutiny on real estate development in ecologically sensitive areas and the importance of complying with environmental standards for future growth in Noida and Greater Noida.
