Haryana Permits S+4 Constructions in Residential Areas

The Haryana government has announced a significant policy change permitting stilt-plus-four floor (S+4) constructions across the state, a move anticipated to benefit the general public substantially. This new regulation extends to old colonies under specific conditions.

Key Highlights of the New Policy

  • Unconditional S+4 Construction: Residential plots in colonies or sectors with an approved layout plan for four dwelling units per plot can now construct S+4 buildings without any conditions.
  • Deen Dayal Upadhyay Jan Awas Yojana: Licensed colonies under this scheme, with an approved or revised service plan for four dwelling units per plot, are also eligible for S+4 constructions.
  • Expert Committee Recommendations: The decision to lift the 16-month ban on S+4 constructions follows recommendations from an expert committee formed after complaints were received about the previous policy.

Conditions for S+4 Constructions

  • Three Dwelling Units Per Plot: In colonies and sectors where the layout plan is approved for three dwelling units per plot, S+4 construction is allowed under certain conditions:
    • The plot must have access from a road at least 10 meters wide.
    • Mutual consent from adjoining plot owners is required unless they have already obtained S+4 approval or maintain a side setback of 1.8 meters on all floors.
    • If adjoining plot owners do not consent, they will be ineligible for future S+4 construction.

Provisions for Basement Construction

  • Existing Permissions: For plots already permitted for three floors and a basement, S+4 construction is allowed, but basement construction and loading on the common wall are prohibited unless there is mutual consent from neighboring plot owners.
  • Common Wall Construction: If an entire row of residential plots is constructed simultaneously, permission for constructing the common wall will be granted.
  • Plot Restrictions: Basement construction is not allowed on plots less than 10 meters in width and 250 square meters in area.

Financial and Administrative Measures

  • Revenue Collection: The government has collected Rs 1178.95 crore from S+4 approvals, with Rs 689.8 crore collected by the Town and Country Planning Department. This amount will be used to enhance infrastructure in all sectors and colonies.
  • Establishment of a Portal: A dedicated portal will be created to address S+4 related issues and provide public information on permissions and approvals.

Future Compliance

To prevent the unauthorized covering of stilt areas, future building plan approvals and occupancy certificates will include a condition that any covering of the stilt area will result in the withdrawal of the building plan approval or occupancy certificate.This policy shift by the Haryana government aims to streamline construction regulations, enhance urban infrastructure, and address public grievances effectively.
