Noida Authority Proposes Changes to FAR Regulations in Noida for Developers

The Noida Authority is planning to revise its bylaws to prevent developers from exploiting the maximum purchasable Floor Area Ratio (FAR) without prior approval. FAR regulations in Noida are crucial for maintaining urban planning standards and ensuring sustainable development. FAR represents the relationship between the total floor area of a building and the size of the plot of land on which it is constructed. For instance, if a developer is allotted a 10,000 sqm plot and the approved layout allows construction on 5,000 sqm, the ground coverage is 50%. If the developer is permitted to build up to 10 storeys, the total built-up area would be 50,000 sqm, resulting in a FAR of 5.

Current Issues and Proposed Solutions

Officials have noted that some developers initially construct up to 2.5 FAR and later add additional floors to reach the maximum purchasable FAR without prior approval, compromising essential aspects like green spaces, parking, and building height. To address this, the Authority is considering two main options:

  1. Mandatory Prior Approval: Developers would be required to obtain permission before constructing up to the purchasable FAR.
  2. Increased Compounding Fees: The fee for unauthorized construction could be raised from Rs 200 per sqm to Rs 2,000 per sqm to deter violations.

These proposals will be discussed in the next board meeting of the Authority.

Approval Process for Additional Construction

Developers wishing to utilize additional FAR must apply to the Authority, which will review various factors such as parking provisions, environmental clearances, fire safety, and building height regulations. The application is then reviewed, and if approved by the CEO, the developer must pay the required fee before proceeding with construction.

Impact of UP-RERA Act

Gaurav Gupta, General Secretary of Credai (NCR), noted that unauthorized construction was more common before the implementation of the UP-RERA Act in 2017. The Act requires developers to disclose all project details upfront, including whether they plan to utilize the basic or purchasable FAR. This has led to increased compliance and fewer instances of unauthorized construction, aligning with the FAR regulations in Noida.
