DLF Building Violations: Massive Crackdown in Gurugram

The Department of Town and Country Planning (DTCP) in Gurugram has identified widespread DLF building violations in 7,500 out of 15,000 surveyed houses across DLF Phases 1 to 5. These violations include unauthorized constructions and the misuse of residential properties for commercial activities such as paying guest accommodations and guest houses.
In DLF Phase 3 alone, over 1,100 show-cause notices were issued, while 81 occupation certificates (OCs) were revoked in Phase 5. The survey, which highlighted rampant non-compliance, was part of a crackdown initiated after Residents’ Welfare Associations (RWAs) of DLF City filed a petition in the Punjab and Haryana High Court. The petition sought strict enforcement against DLF building violations, and DTCP’s findings will be submitted to the High Court before a January 10 hearing.
Properties Sealed for Non-Compliance
DTCP has already sealed numerous properties found in violation of norms, with over 800 properties sealed last month across various residential colonies. However, enforcement challenges remain as many properties resume illegal activities after obtaining court stays. The issue of DLF building violations continues to pose a significant challenge for authorities.
‘No-Nuisance’ Policy and Penalties
In licensed colonies, a ‘no-nuisance’ policy allows limited commercial activities on up to 25% of the ground floor area. Approved activities include professional offices for lawyers, doctors, architects, and chartered accountants, which require prior permission and payment of a ₹60,000 fee for a five-year term. Properties found violating these norms face strict penalties, including OC cancellation, property sealing, and even FIRs against owners.
Next Steps and Future Actions
According to Amit Madholia, DTP (Enforcement), the ongoing survey will play a critical role in shaping future enforcement strategies. The department is awaiting the High Court’s directions after the January 10 hearing to proceed with further actions, including issuing restoration orders.
DTCP reaffirmed its commitment to tackling illegal activities and addressing building violations in DLF colonies. The focus remains on resolving enforcement challenges and promoting lawful development in Gurugram.
