How Consumer Courts Resolve Real Estate Related Complaints

Over 50,000 real estate related complaints/cases are currently pending in consumer courts across India, according to government data presented to the Lok Sabha by Minister of State for Food and Consumer Affairs, B L Verma. As of July 31, 2024, a total of 2,44,813 cases have been filed in consumer courts at the national, state, and district levels, with 1,94,555 cases resolved and 50,258 cases still pending.
The Consumer Protection Act, 2019, establishes a three-tier quasi-judicial system known as ‘Consumer Commissions’ at the district, state, and central levels. This system is intended to safeguard consumer rights and provide a fast and straightforward resolution of disputes. The Act simplifies the adjudication process, allowing consumers to file real estate related complaints, participate in virtual hearings, and benefit from the deemed admissibility of complaints if not addressed within 21 days of filing.
Section 38(7) of the Consumer Protection Act mandates that real estate related complaints should be resolved as quickly as possible, ideally within three months if no analysis or testing of commodities is required, and within five months if such analysis is necessary.
To facilitate the filing of real estate related complaints, the e-Daakhil portal has been launched in 35 states and union territories, enabling consumers to submit complaints online from anywhere in India. This initiative aims to streamline the complaint process and improve access to consumer justice.
