Gurugram Stilt-Plus-Four Floors Policy: Latest Court Update

On Wednesday, the Punjab and Haryana High Court clarified that it had not imposed a stay on the Gurugram stilt-plus-four floors policy. This clarification addressed the confusion surrounding the policy’s status, following claims from some realtors that a stay had been issued.

The bench, consisting of Justices Arun Palli and Vikram Aggarwal, noted that the decision to implement the Gurugram stilt-plus-four floors policy rests with the Department of Town and Country Planning (DTCP). Additional Advocate General Ankur Mittal, representing the government, confirmed that the DTCP had indeed placed the Gurugram stilt-plus-four floors policy on hold, but no court order had prevented its implementation.

The confusion arose when the Gurgaon Citizens Council (GCC) filed a petition seeking a stay on the Gurugram stilt-plus-four floors policy, which permits buildings with stilt parking and four additional floors. In February 2023, the DTCP suspended this policy and formed an expert committee to assess whether S+4 construction should continue in Gurugram. However, in July 2024, the department issued new guidelines for the Gurugram stilt-plus-four floors policy, raising questions about its current status.

The revised guidelines permitted S+4 construction in areas where the layout plan accommodated three floors with stilt parking and roads of 10 meters in width. Additionally, the DTCP proposed new standards for issuing occupation certificates (OCs) for buildings with extra floors built without prior permissions and suggested creating a portal for more transparent approval of such building plans.

Developers have since filed a separate petition to be included in the case, prompting the court to issue a notice to the GCC for a response. The next hearing is scheduled for October 23, 2024.

As the situation evolves, realtors are hopeful that the high court’s clarification indicates that the DTCP may soon introduce revised guidelines for the Gurugram stilt-plus-four floors policy. Narendra Yadav, President of the Gurugram Home Developers Association, remarked that the absence of a court order against the Gurugram stilt-plus-four floors policy suggests that new directives could be on the horizon.
