New Policy to Simplify GPA Property Transfers in Noida

The Noida Authority is in the process of introducing a new policy that will allow registries for residential plots and flats transferred through multiple General Power of Attorneys (GPAs). This initiative aims to address long-standing legal uncertainties around GPA property transfers while recovering substantial revenue losses incurred by the Authority and the Uttar Pradesh government over the years.

Tackling Legal Complexities in GPA Property Transfers

Currently, property transfers in Noida face significant hurdles, especially in cases involving multiple GPAs. Under existing rules, only first GPA holders are recognized for transfer approvals, with fees ranging from 2.5% to 5% based on the type of transfer. However, properties transferred through subsequent GPAs remain in legal limbo, leaving numerous families without ownership rights.

According to officials, the new policy is designed to resolve these issues and ensure legitimate ownership for thousands of properties across Noida. “The issue of multiple GPAs is critical and requires immediate attention,” said Lokesh M, CEO of Noida Authority. He confirmed that the proposed policy would soon be submitted to the state government for approval.

The Scale of the Problem

The extent of this problem is substantial. For example, in Jalvayu Vihar’s sectors 21 and 25, a report by the Air Force Naval Housing Board identified 730 GPA-based properties, of which 200 involve multiple GPAs. Citywide, officials estimate the number could reach several thousand, demonstrating the widespread challenges of GPA property transfers.

Proposed Fee Structure for GPA Property Transfers

To address these challenges, the policy introduces a tiered fee structure:

  • First GPA Holder Transfers: Fees remain unchanged, ranging from 2.5% to 5% of the property rate.
  • Second GPA Holder Transfers: A 10% fee of the prevailing property rate.
  • Third GPA Holder Transfers: A 15% fee of the prevailing property rate.
  • Further Transfers: An incremental fee of 5% per transfer.

This progressive fee system is expected to generate significant revenue through GPA property transfer fees and increased stamp duty collections, boosting government coffers while providing much-needed clarity for property holders.

Lessons from Past GPA Property Transfer Policies

The new proposal is a follow-up to a 2003 government order that also dealt with GPA property transfers. The earlier policy enabled the transfer of 600 properties through a progressive fee system but lacked longevity, with extensions granted sporadically between 2003 and 2006. Subsequent efforts in 2008, 2014, and 2017 failed to yield results, leaving many families in legal uncertainty.

Looking Ahead: A Landmark in GPA Property Transfers

Officials believe the proposed policy will be a game-changer for Noida’s property administration system. By addressing GPA property transfer complexities, it promises to resolve disputes, provide security to affected families, and create a transparent mechanism for property ownership transfers.

The Noida Authority is expected to finalize and submit the policy to the state government soon. If implemented, it could mark a significant milestone in the city’s real estate management and unlock vast revenue potential for public infrastructure development.
