UP-RERA Takes Action Against Delayed Possession by Promoters

The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) is intensifying its efforts to ensure timely possession of properties to allottees. Recently, UP-RERA referred 250 cases concerning possession delays to the adjudicating officers at its Lucknow and Gautam Budh Nagar offices. Specifically, 130 cases were directed to Lucknow, and 120 were assigned to Gautam Budh Nagar.

Enforcement of Compliance

Sanjay Bhoosreddy, the chairman of UP-RERA, has been actively reviewing the compliance status of orders issued to promoters. It was found that many promoters were delaying the delivery of possession to allottees despite clear orders to do so within a specified timeframe. To tackle this issue, adjudicating officers have been granted authority under Rule-24 of the UP-RERA Rules, 2018, providing them with powers similar to those of the Code of Civil Procedure (CPC). This includes the power to expedite the delivery of possession, execute sale deeds, attach units, and appoint receivers if necessary.

Strengthening the Process

To further streamline the process, UP-RERA has implemented a system where any case of non-compliance by promoters will be referred to the adjudicating officers with the chairman’s approval. Bhoosreddy has expressed strong disapproval of promoters’ failure to comply with possession orders and has committed to regularly reviewing compliance statuses. He aims to take all necessary remedial measures to protect the interests of allottees.

Penalties for Non-Compliance

In cases where promoters fail to deliver possession as ordered, UP-RERA plans to impose significant penalties. These penalties will be enforced through the district magistrate to ensure recovery. The adjudicating officers are tasked with conducting effective, time-bound proceedings to ensure that sale deeds are executed and possessions are delivered promptly.
