Delhi High Court Ruling in Oberoi Group Inheritance Dispute

New Delhi — In a pivotal development in the Oberoi Group inheritance dispute, the Delhi High Court has issued an interim injunction preventing the transfer of shares in EIH Limited, the flagship company of the renowned Oberoi Group. This legal action comes in response to a lawsuit initiated by Anastasia Oberoi and her mother, Mirjana Jojic Oberoi, targeting Anastasia’s siblings Vikramjit Singh Oberoi and Natasha Devi Oberoi, as well as their cousin Arjun Singh Oberoi.

The dispute revolves around the will of the late PRS Oberoi, a prominent hotelier and Chairman Emeritus of The Oberoi Group, who passed away on November 14, 2023. The plaintiffs allege that Vikramjit Singh and Arjun Singh Oberoi have been obstructing the execution of PRS Oberoi’s will, dated October 25, 2021. According to this will, PRS Oberoi’s shares were to be divided between his daughters Natasha and Anastasia, with Anastasia’s shares allocated through a trust.

As part of the ongoing Oberoi Group inheritance dispute, the court has recognized the plaintiffs’ substantial case and potential for serious harm if the shares and properties are transferred before a final resolution. Therefore, the court has barred the defendants from transferring or transmitting shares in EIH Limited, Oberoi Hotels Pvt Ltd, and Oberoi Properties Pvt Ltd. Furthermore, the court has safeguarded the family residence in Kapashera, Delhi, ensuring Anastasia and her mother can continue to occupy and enjoy the property.

The defendants contend that the 2021 will does not reflect PRS Oberoi’s true intentions, citing a 1992 will that aligns with a previous oral agreement between PRS Oberoi and his father, Rai Bahadur MS Oberoi. They also argue that company regulations limit the transfer of shares to a trust without offering them to existing shareholders first.

Justice Navin Chawla’s interim order underscores the necessity of maintaining the current state during the Oberoi Group inheritance dispute until the court reviews the responses from the defendants. This legal conflict underscores the ongoing challenges within the Oberoi family concerning the succession of one of India’s premier luxury hotel chains.
