Gurugram Denies NBCC’s Demolition Request for Green View Society
Gurugram: The district administration has denied the National Buildings Construction Corporation (NBCC) permission to demolish its Green View Society project in Sector 37D. The decision comes after structural audits by IIT-Roorkee and the Central Building Research Institute (CBRI) deemed the buildings unsafe.
Safety Concerns and Legal Disputes
NBCC’s Demolition Request for the seven towers was submitted on June 25, citing grave dangers to residents due to structural problems. The developer referenced a February 17, 2022, order by the district magistrate and the District Disaster Management Authority, which highlighted threats to life and property. However, the request faced objections from flat owners, particularly those from the Economically Weaker Section (EWS), who have approached the Delhi High Court over unresolved compensation claims.
Administrative Response
The district administration’s decision to deny the NBCC’s demolition request is influenced by ongoing protests from EWS allottees and the pending court case. At a recent Samadhan camp, EWS flat owners expressed their concerns regarding unresolved compensation claims and ongoing legal proceedings. The District Town Planning Enforcement (DTPE) has informed NBCC that the final High Court order must be followed and has requested the deputy commissioner to provide guidelines for registering the flats of EWS allottees to facilitate their compensation claims.
Compensation Offers and Resident Reactions
In March, NBCC began the process of offering compensation and rent to flat owners following an order by the National Consumer Disputes Redressal Commission. Flat owners who opted for reconstruction were offered rent at Rs 15 per sq ft, while those preferring compensation were offered the total amount paid to the company with 9% interest plus an additional Rs 10 lakh as exemplary damages. However, the allottees have not accepted these offers.
Official Statement
Deputy Commissioner Nishant Yadav stated, “Residents have requested that demolition not proceed while the matter is still pending in court.” Therefore, we have asked NBCC to take up its request with the court.
Current Status
NBCC must now obtain the High Court’s permission and comply with its orders before proceeding with any demolition activities. The Green View project, launched in 2010 and handed over in 2017, comprises 784 apartments in seven towers and 139 EWS flats. Despite the structural issues and safety concerns, the demolition cannot proceed without resolving the compensation claims and obtaining the necessary judicial approvals.
